What Changed on 2 October 2026 — and What the New Student Visa Transfer Stream Means for You

Published: 23 October 2026 | Clinton Institute (RTO 41597, CRICOS Provider: 03540C) | Melbourne

Two things changed in October that change how you start and how you move. From 2 October 2026, most temporary visa holders can no longer lodge a student visa application from inside Australia. And from mid-2027, a dedicated Student visa transfer stream applies, with transfers permitted only at the same AQF level or above. Here is what each one means in plain terms.

The 2 October rules are already live and being enforced. If you are in Australia on a 417, 462, 482, 457, 407, 408 or 400 visa, the subclass 500 and 590 onshore lodgement path is closed. Offshore applicants must be outside Australia both when they lodge and when the visa is granted. Family member inclusion has been largely removed, and the primary applicant and any family included must be in the same country at lodgement. The provider transfer restriction was extended to 12 months, running until 30 June 2027, and the financial requirement rose to AUD $29,710 per year, with IELTS 6.0 overall as the minimum English requirement.

Then there is the news hook that no competitor page is carrying. On 2 October 2026 ASQA reported that Assistant Minister Julian Hill MP has made a temporary change to Standard 7 of the National Code on the transfer restriction period for overseas students. A dedicated Student visa transfer stream applies from mid-2027. From 1 July 2027, students must hold the new visa before commencing study at a new provider, the new visa's end date stays the same, and transfers are permitted only at the same AQF level or above.

That last clause is the one to sit with. The level you start at now has a longer shelf life than it used to. Choosing Certificate III in Individual Support (CHC33021) when your plan is a Certificate IV or a Diploma is a decision with a deadline attached — and the deadline is 1 July 2027. Providers are updating ESOS and transfer advice now, which means this is live advice, not future speculation.

The practical response is straightforward. If you are starting in 2026, start at the level that matches where you are actually going, and ask your provider about the transfer pathway before you enrol rather than after. If you are mid-course, talk to your provider now about what the 12-month restriction means for your completion date. Our longer breakdown of the onshore lodgement change is in Student Visa Changes — October 2026, and the workplace consequences are in How Australia Visa Changes Affect Aged Care Students.

Frequently Asked Questions

+ What changed on 2 October 2026 for student visas?
From 2 October 2026, most temporary visa holders in Australia — including 417, 462, 482, 457, 407, 408 and 400 visa holders — can no longer lodge a subclass 500 or 590 student visa application from inside Australia. Offshore applicants must be outside Australia both when the application is lodged and when the visa is granted. Family member inclusion has been largely removed, and the primary applicant and any family included must be in the same country at lodgement. The provider transfer restriction was extended to 12 months, running until 30 June 2027.
+ What is the new Student visa transfer stream?
ASQA announced on 2 October 2026 that Assistant Minister Julian Hill MP has made a temporary change to Standard 7 of the National Code on the transfer restriction period for overseas students. A dedicated Student visa transfer stream applies from mid-2027. From 1 July 2027, students must hold the new visa before commencing study at a new provider, the new visa's end date stays the same, and transfers are only permitted at the same AQF level or above.
+ Does the AQF level rule affect my course choice?
Yes. From 1 July 2027 a transfer will only be permitted at the same AQF level or above, so choosing your starting qualification now has a longer-term consequence than it used to. Starting at Certificate III in Individual Support (CHC33021) when you intend to move to a Certificate IV or Diploma later is not the same decision as starting at the Diploma. Talk to a provider about your intended pathway before you enrol, not after.
+ What are the new financial and English requirements?
The student visa financial requirement increased to AUD $29,710 per year from 2 October 2026, and the minimum English requirement is IELTS 6.0 overall with the Genuine Student test replacing the previous GTE. Applications lodged before 2 October 2026 are assessed under the previous rules.
+ Can I still apply for a student visa from inside Australia?
If you hold a temporary visa listed in the new rules, the onshore lodgement path for subclass 500 and 590 is closed. If you are applying from outside Australia you apply from your home country, and you must be outside Australia when the visa is granted. This is why the 9 November 2026 CHC33021 intake at Clinton Institute matters as the last clean 2026 start for most offshore pathways.
